What we collect
We collect only what we need in order to advise and represent you.
- Your name, address, telephone number and email address
- Details of the matter you have asked us to advise on
- Information required to assess legal aid eligibility, where relevant
- Correspondence between you and this firm
- Anything you send us through the enquiry form on this website
Why we use it
We process your information to provide legal advice and representation, to meet our professional and regulatory obligations, to apply for legal aid on your behalf where appropriate, and to keep the records the law requires us to keep.
Our lawful bases are the performance of a contract with you, compliance with a legal obligation, and the establishment, exercise or defence of legal claims. Where we handle special category data, including information about alleged offences, we do so on the basis of legal claims and substantial public interest.
Who we share it with
We do not sell your information and we do not share it for marketing. We share it only where the work requires it, or where the law requires it.
- Advocates and counsel instructed on your case
- Expert witnesses instructed with your agreement
- The court and the prosecution, as court procedure requires
- Scottish Legal Aid Board, where a legal aid application is made
- Our regulator, the Law Society of Scotland, where it exercises its powers
- Our insurers and auditors, under a duty of confidence
How long we keep it
We keep client files for the period set by our professional obligations and by the nature of the matter, after which they are securely destroyed. If you would like the retention period that applies to your file, ask us and we will tell you.
Your rights
You have the right to ask for a copy of the information we hold about you, to have inaccurate information corrected, to ask us to restrict how we use it, and in some circumstances to ask for it to be erased or to object to our using it.
Some of these rights are limited where we are under a legal or professional duty to keep a record. We will explain if that applies.
